Bauterminal

Terms of Service

Effective from 02.09.2026

These terms of service (the terms) govern the use of the website bauterminal.ee (the website) operated by Bauterminal OÜ (registry code 17574030, address Jaama tn 14, Nõmme linnaosa, 11615 Tallinn, Harju maakond, Estonia; Bauterminal or seller), as well as the submission of quote requests and the placing of orders through the website.

By using the website and/or submitting a quote request, the user (the customer) confirms that they have read and agree to these terms.

1. General provisions

Bauterminal is engaged in the wholesale and retail sale of building materials, construction chemicals and finishing supplies to both private individuals and legal entities. The website allows browsing the product catalog and submitting a quote request — submitting a request through the website is not, by itself, a binding purchase contract, but an expression of interest in receiving an offer.

2. Quote requests and forming an order

The customer may select products on the website and submit a quote request for them. Bauterminal will contact the customer no later than the following business day and provide a personal price offer including the final price, delivery terms and timeline.

A sales contract is considered concluded once the customer confirms the price offer (in writing, by email, or another agreed method) and Bauterminal has received that confirmation. Until the offer is confirmed, neither party has a binding obligation to conclude the transaction.

3. Product information and prices

Product information, images and technical data shown on the website are for informational purposes and may differ slightly from reality (for example, colours shown on screen). Prices on the website are indicative and may not reflect quantity, transport, or other discounts — the final price is confirmed in the personal offer.

Bauterminal reserves the right to change prices and product information shown on the website at any time without prior notice. Changes made after an offer has been confirmed do not affect the price already agreed with the customer.

4. Payment terms

Payment is made based on the invoice issued by Bauterminal, by the deadline and under the terms stated on the invoice, unless otherwise agreed. Ownership of the goods passes to the customer upon receipt of full payment, unless the invoice states otherwise.

5. Delivery

The delivery time is agreed when the offer is confirmed and is an estimate — the exact delivery time depends on the manufacturer's/supplier's stock and is not guaranteed by Bauterminal unless a fixed deadline has been separately agreed. The risk of accidental loss or damage to the goods passes to the customer upon handover of the goods to the customer or the customer's designated carrier.

The customer is obligated to check the goods upon receipt for conformity with the order and correct quantity, and to notify Bauterminal of any visible defects without delay.

6. Right of withdrawal

A consumer customer (a natural person not acting for purposes related to their trade, business or profession) has the right to withdraw from a distance contract within 14 days of receiving the goods, without giving a reason, pursuant to the Estonian Law of Obligations Act. The right of withdrawal does not apply where the delivered goods are manufactured to the customer's specifications, are clearly personalised, are liable to deteriorate or expire rapidly, or in other cases set out in the Law of Obligations Act (e.g. goods that are unsealed after delivery and are not suitable for return for health or hygiene reasons).

The right of withdrawal set out in law does not apply to business customers (legal entities) — in such cases, the terms agreed between the parties apply.

7. Complaints and claims

If the delivered goods do not conform to the contract (defective, incomplete or incorrect goods), the customer has the right to submit a claim within two years of the goods being handed over, notifying Bauterminal within a reasonable time after discovering the defect. The claim must be submitted in writing by email (info@bauterminal.com) together with a description of the goods, proof of purchase, and photos where possible.

Bauterminal will respond to the claim and offer a resolution (repair, replacement, price reduction, or termination of the contract) within 15 days. In the event of a dispute, a consumer customer has the right to contact the Consumer Disputes Committee of the Estonian Consumer Protection and Technical Regulatory Authority (www.tarbijakaitseamet.ee) or the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).

8. Limitation of liability

Bauterminal is liable for direct financial loss caused to the customer to the extent provided by law. Bauterminal is not liable for indirect damage (e.g. lost profit), nor for damage caused by the actions of third parties (manufacturers, carriers) or force majeure.

9. Processing of personal data

The collection and processing of personal data is governed by our privacy policy, which forms an integral part of these terms.

10. Governing law and dispute resolution

These terms and any contracts concluded under them are governed by the laws of the Republic of Estonia. Disputes will first be resolved through negotiation; failing agreement, the dispute will be resolved in Harju County Court, unless the law provides otherwise.

11. Changes to these terms

Bauterminal may unilaterally amend these terms by publishing a new version on the website together with its effective date. Offers already confirmed remain subject to the terms in effect at the time the offer was made.
